This Privacy Policy describes how Omalo (“Omalo,” “we,” “us,” or “our”) collects, uses, discloses, and otherwise processes personal information in connection with the website located at omalo.net (the “Site”), and the rights and choices available to individuals with respect to that information.

1. Scope of This Policy

This Privacy Policy applies to personal information that we process in connection with the Site, including information that you submit through the demonstration request form made available on the Site and information contained in correspondence between you and us. For the purposes of applicable data protection laws, Omalo is the party responsible for the processing of personal information described in this Privacy Policy (the “controller”). Our contact details are set out in Section 15.

This Privacy Policy does not apply to information that we process on behalf of our customers in the course of providing our products and services, which is governed by the agreements between Omalo and those customers, nor to any third-party website, product, or service, even if linked to or referenced on the Site.

2. Information We Collect

2.1 Information You Provide to Us

When you request a demonstration through the Site, we collect the information that you enter into the request form, namely your name, your work email address, the name of your company (if provided), and the content of any message that you choose to include. If you correspond with us by email, we also collect the content of that correspondence and the contact details associated with it.

You are under no legal obligation to provide us with personal information. The provision of such information is voluntary and is subject to your consent. If you choose not to provide the information marked as required in the request form, however, we will be unable to respond to your request.

We ask that you not include in the request form, or in any correspondence with us, any sensitive personal information (such as government-issued identification numbers, financial account information, or information concerning health), or any confidential information belonging to you or to a third party.

2.2 Information Collected Automatically

The Site does not use cookies, analytics tools, advertising technologies, or similar tracking technologies, and we do not collect information about your browsing activity on the Site. As is the case with any website, the service provider that hosts and delivers the Site on our behalf necessarily processes certain technical information in order to transmit the Site to your device and to protect it against malicious activity. This information includes your Internet Protocol (IP) address, the type and version of your browser and operating system, the pages or files requested, and the date and time of each request.

When you submit the request form, the service provider that processes the submission on our behalf may likewise receive technical information associated with the submission, such as your IP address and browser type, which it uses to transmit the submission and to detect spam and abuse.

3. How We Use Information

We use the personal information described above for the following purposes:

• to respond to your request or inquiry, to schedule and conduct a demonstration of our products and services, and to communicate with you in connection with that request;
• to evaluate, establish, and maintain a business relationship with you or with the organization that you represent;
• to operate, maintain, secure, and protect the Site, including by detecting and preventing spam, fraud, abuse, and security incidents;
• to comply with our legal and regulatory obligations and to respond to lawful requests of public authorities; and
• to establish, exercise, or defend legal claims, and to enforce our Terms of Use.

We do not sell personal information, we do not use personal information for targeted or behavioral advertising, and we do not use personal information to make decisions based solely on automated processing that produce legal or similarly significant effects concerning you.

4. Cookies, Tracking Technologies, and “Do Not Track”

The Site does not set cookies on your device, does not use local storage or similar technologies to store or access information on your device, and does not incorporate third-party analytics, advertising, or social media technologies. We do not track visitors over time or across third-party websites, and we do not permit third parties to collect personal information about your online activities over time and across different websites when you use the Site.

Because the Site does not engage in such tracking, the Site does not respond differently to “Do Not Track” signals or other similar browser-based mechanisms; your experience of the Site is the same whether or not such a signal is enabled.

Should we introduce analytics or similar technologies in the future, we will update this Privacy Policy before doing so and, where required by applicable law, will request your consent.

5. How We Disclose Information

We disclose personal information only as described below:

• Service providers. We engage third-party service providers that process personal information on our behalf and in accordance with our instructions, in order to operate the Site and our business. These providers currently consist of Cloudflare, Inc. (website hosting, content delivery, and security), Formspree, Inc. (processing and transmission of request form submissions), and Google LLC (business email and productivity services).
• Professional advisors. We may disclose personal information to our legal counsel, accountants, auditors, and other professional advisors, to the extent necessary for the services they render to us.
• Legal compliance and protection of rights. We may disclose personal information where we believe in good faith that disclosure is required by applicable law, regulation, legal process, or a binding governmental request, or is necessary to protect the rights, property, or safety of Omalo, our users, or others, including to detect and prevent fraud and to establish, exercise, or defend legal claims.
• Business transfers. We may disclose or transfer personal information in connection with, or during the negotiation of, any merger, acquisition, financing, reorganization, sale of all or a portion of our assets, or similar corporate transaction, subject to customary confidentiality undertakings.
• With your consent. We may disclose personal information for any other purpose with your consent or at your direction.

6. International Transfers

Omalo is based in the State of Israel, and the service providers identified in Section 5 are located in, or may process information in, the United States and other countries. Accordingly, your personal information may be transferred to, and stored and processed in, countries other than the country in which you reside, the data protection laws of which may differ from those of your jurisdiction.

The European Commission has recognized the State of Israel as providing an adequate level of protection for personal data. Where we transfer personal information to other jurisdictions, we take the measures required by applicable law so that the information continues to benefit from an appropriate level of protection, which may include reliance upon adequacy decisions or the conclusion of standard contractual clauses or comparable contractual undertakings with the recipient.

7. Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes for which it was collected, including for the duration of our correspondence and business relationship with you, and thereafter for as long as necessary to comply with our legal obligations, to resolve disputes, and to establish, exercise, or defend legal claims. When personal information is no longer required for these purposes, we delete it or render it anonymous. In determining the appropriate retention period, we consider the nature of the information, the purposes for which it is processed, and the applicable legal requirements.

8. Security

We maintain administrative, technical, and organizational measures that are designed to protect personal information against unauthorized or unlawful access, use, alteration, disclosure, loss, or destruction. No method of transmission over the Internet, and no method of electronic storage, is completely secure, however, and we cannot guarantee the absolute security of your personal information. You are responsible for the information that you choose to transmit to us.

9. Your Rights and Choices

Subject to applicable law, and depending on your place of residence, you may have the right to request access to the personal information that we hold about you, to request that inaccurate, incomplete, unclear, or outdated information be corrected, and to request that your personal information be deleted. In particular, individuals whose personal information is held in a database in Israel are entitled to review that information and to request its correction or deletion in accordance with sections 13 and 14 of the Israeli Privacy Protection Law, 5741-1981.

We may request information reasonably necessary to verify your identity before acting upon your request, and we will respond within the period required by applicable law. We will not discriminate against you for exercising any of your rights. If we decline your request, in whole or in part, we will inform you of the reasons, to the extent required by law.

You may also ask us at any time to cease contacting you, by replying to any message that you receive from us or by writing to the address above.

10. Additional Information for Individuals in the EEA, the United Kingdom, and Switzerland

The Site is directed principally to business professionals in the United States. To the extent that the General Data Protection Regulation (EU) 2016/679, the United Kingdom General Data Protection Regulation, or the Swiss Federal Act on Data Protection applies to our processing of your personal information, the following additional information applies.

Legal bases. We process personal information on the following legal bases: (a) where processing is necessary in order to take steps at your request prior to entering into a contract, such as responding to a demonstration request; (b) where processing is necessary for the purposes of our legitimate interests, namely responding to business inquiries, developing our business relationships, and operating and securing the Site, provided that those interests are not overridden by your interests or fundamental rights and freedoms; (c) where processing is necessary for compliance with a legal obligation to which we are subject; and (d) where applicable, your consent, which you may withdraw at any time without affecting the lawfulness of processing carried out before the withdrawal.

Your rights. In addition to the rights described in Section 9, you may have the right to request the restriction of processing of your personal information, to object to processing that is based on our legitimate interests, and to receive the personal information that you provided to us in a structured, commonly used, and machine-readable format. You also have the right to lodge a complaint with the data protection supervisory authority of your habitual residence, your place of work, or the place of the alleged infringement. We would, however, welcome the opportunity to address your concerns first, and we encourage you to contact us.

11. Additional Information for Residents of the United States

We do not sell personal information, and we do not share or otherwise disclose personal information for purposes of cross-context behavioral advertising or targeted advertising. We have not done so in the preceding twelve (12) months. Residents of certain states may have rights under the privacy laws of their state with respect to their personal information, where those laws apply to us. Irrespective of whether such laws apply, we will consider any request submitted in accordance with Section 9.

California residents may review the categories of personal information that we collect in Section 2, the categories of third parties to which we disclose it in Section 5, the process for requesting access to or correction of personal information in Section 9, our response to “Do Not Track” signals in Section 4, and the manner in which we give notice of changes to this Privacy Policy in Section 14.

12. Children

The Site is intended for business professionals and is not directed to children. We do not knowingly collect personal information from individuals under the age of eighteen (18). If you believe that a child has provided personal information to us, please contact us at the address set out in Section 15, and we will take appropriate steps to delete that information.

13. Third-Party Websites and Services

The Site may refer or link to websites, publications, or services operated by third parties, including governmental bodies. We do not control, and are not responsible for, the privacy practices or the content of any third party. We encourage you to review the privacy policy of every website that you visit.

14. Changes to This Policy

We may amend this Privacy Policy from time to time. The amended Privacy Policy will be posted on this page, and the “Last Updated” date above will be revised accordingly. Where an amendment materially affects the manner in which we process personal information, we will provide prominent notice on the Site before the amendment takes effect and, where required by applicable law, will request your consent. We encourage you to review this Privacy Policy periodically.
